1. Introduction and Acceptance

These Terms and Conditions ("Terms") govern your use of winter expedition planning services provided by snoweilo ("Company," "we," "us," or "our"), operating from Singapore. By booking our services, using our website, or communicating with us about potential bookings, you ("Client," "you," or "your") agree to be bound by these Terms.

If you do not agree with any part of these Terms, please do not use our services. These Terms should be read alongside our Privacy Policy and Cookie Policy.

2. Definitions

  • "Services" means winter expedition planning, booking coordination, preparation guidance, and related services provided by snoweilo
  • "Client" or "You" means the individual or entity booking Services through snoweilo
  • "Booking" means a confirmed reservation for expedition services following deposit payment
  • "Itinerary" means the planned schedule of activities, accommodation, and transportation
  • "Third-Party Providers" means accommodation establishments, guide services, transport operators, and other service suppliers

3. Service Scope and Use

3.1 Services Provided

snoweilo provides:

  • Winter expedition planning and itinerary development
  • Booking coordination with accommodation, guides, and transport providers
  • Pre-departure preparation guidance and briefings
  • Communication support during expeditions
  • Post-expedition feedback collection

3.2 Age Requirements

Services are available to individuals 18 years and older. Bookings for minors (under 18) require adult supervision and guardian consent throughout the expedition.

3.3 Account Responsibilities

You are responsible for maintaining accurate contact and personal information. You must inform us promptly of any changes affecting your booking or ability to participate in the expedition.

4. Prohibited Uses

You agree not to:

  • Provide false or misleading information during booking or preparation
  • Use Services in violation of Singapore laws or destination country regulations
  • Engage in activities that endanger yourself, other travelers, or service providers
  • Harass, threaten, or abuse our staff, guides, or third-party providers
  • Interfere with other travelers' experiences or expedition operations
  • Resell or transfer your booking without our written consent
  • Attempt unauthorized access to our systems or data

5. Booking and Payment Terms

5.1 Currency and Pricing

All prices are quoted in Singapore Dollars (SGD) unless otherwise specified. Prices include services explicitly listed in the booking confirmation. International flights, travel insurance, most meals, personal equipment, and optional activities are typically excluded unless stated otherwise.

5.2 Payment Schedule

  • Deposit: 30% of total cost due upon booking confirmation
  • Balance: 70% of total cost due 60 days before expedition departure date
  • Late Bookings: Full payment required for bookings made within 60 days of departure

5.3 Accepted Payment Methods

We accept bank transfers, credit cards (Visa, Mastercard), and other methods as confirmed during booking. Payment processing fees, if any, will be disclosed before payment.

5.4 Price Changes

Prices are guaranteed once deposit is paid and booking is confirmed. We reserve the right to adjust prices for future bookings based on exchange rates, supplier costs, or operational factors.

5.5 Taxes

Applicable Singapore taxes (GST) are included in quoted prices. Destination country taxes or fees may apply separately and will be disclosed where known.

6. Cancellation and Refund Policy

6.1 Client Cancellation

  • More than 90 days before departure: Full refund minus 10% administrative fee
  • 60-90 days before departure: 50% refund of total cost
  • 30-59 days before departure: 25% refund of total cost
  • Less than 30 days before departure: No refund

6.2 Processing Time

Refunds will be processed within 30 business days of cancellation confirmation. Refunds will be issued to the original payment method.

6.3 Non-Refundable Items

Third-party provider fees that cannot be recovered (such as certain accommodation deposits or permit fees) are non-refundable regardless of cancellation timing.

7. Changes and Modifications

7.1 Client-Requested Changes

Changes to confirmed bookings (dates, destinations, accommodation) are subject to availability and may incur fees. Requests must be made in writing at least 45 days before departure.

7.2 Company-Initiated Changes

We reserve the right to modify itineraries due to weather, safety concerns, supplier issues, or circumstances beyond our control. We will notify you promptly and offer alternatives or refunds for significant changes.

8. Travel Insurance Requirement

Comprehensive travel insurance including medical coverage, emergency evacuation, trip cancellation, and personal liability is MANDATORY for all expeditions. Proof of insurance must be provided before final payment deadline. We recommend policies covering winter sports and cold climate activities specifically.

9. Health and Fitness Requirements

You are responsible for ensuring you meet the physical and medical requirements for your chosen expedition. You must disclose relevant health conditions during booking that could affect your participation or require special arrangements. We reserve the right to refuse service if undisclosed conditions create safety risks.

10. Disclaimers and Limitations of Liability

10.1 Service "As Is" Provision

Services are provided "as is" without warranties of any kind, express or implied. We coordinate high-quality service providers but cannot guarantee their performance or control all aspects of your experience.

10.2 Third-Party Provider Actions

We are not liable for actions, errors, or omissions of third-party accommodation, transport, or guide services. Claims arising from third-party provider performance should be directed to those providers.

10.3 Limitation of Liability

Our total liability for any claim is limited to the amount you paid for Services. We are not liable for indirect, incidental, consequential, or punitive damages including lost profits, data loss, or emotional distress.

10.4 Weather and Natural Conditions

Winter expeditions involve inherent risks from weather, terrain, and climate. We provide guidance and safety protocols but cannot control natural conditions. You assume risks associated with cold climate travel.

10.5 Force Majeure

We are not liable for failure to perform Services due to circumstances beyond reasonable control including natural disasters, political instability, pandemics, strikes, or government actions.

11. Intellectual Property

All content on our website, including text, graphics, logos, images, and itinerary documents, is owned by snoweilo and protected by copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works without written permission. Limited use is granted for personal, non-commercial purposes related to your booking.

12. Photography and Content Use

We may take photographs or videos during expeditions for marketing purposes. By participating, you consent to use of media featuring you in our promotional materials. You may opt out by notifying us in writing before departure.

13. Termination

13.1 Our Right to Terminate

We may terminate Services immediately if you:

  • Breach these Terms
  • Engage in dangerous or illegal activities
  • Threaten health or safety of others
  • Fail to make required payments

Termination for cause results in forfeiture of all payments.

13.2 Effect of Termination

Upon termination, your right to use Services ceases immediately. Provisions regarding payment, liability, and dispute resolution survive termination.

14. Dispute Resolution

14.1 Informal Resolution

Before initiating formal proceedings, you agree to contact us at [email protected] to attempt informal resolution. We will respond within 10 business days.

14.2 Mediation

If informal resolution fails, disputes will be submitted to mediation in Singapore before proceeding to arbitration or litigation.

14.3 Jurisdiction and Governing Law

These Terms are governed by Singapore law. Any disputes will be subject to the exclusive jurisdiction of Singapore courts.

15. General Provisions

15.1 Entire Agreement

These Terms, along with our Privacy Policy and booking confirmation, constitute the entire agreement between you and snoweilo regarding Services.

15.2 Severability

If any provision is found unenforceable, remaining provisions remain in full effect.

15.3 No Waiver

Our failure to enforce any right or provision does not constitute waiver of that right or provision.

15.4 Assignment

You may not assign or transfer your booking without our written consent. We may assign our rights and obligations to affiliated entities.

15.5 Notice Procedures

Legal notices must be sent to [email protected] or our registered address. We will send notices to the email address you provided during booking.

16. Changes to Terms

We may update these Terms to reflect changes in our practices or legal requirements. Updated Terms will be posted with a revised "Last Updated" date. Significant changes will be communicated via email. Your continued use after updates constitutes acceptance of revised Terms.
